TERMS AND CONDITIONS
The following terms and conditions (“Terms and Conditions”) contain important information regarding the Best Friends Forever (“Sponsor”) Loyalty Rewards Program (the “Program”). Please read the following Terms and Conditions carefully, These Terms and Conditions are a binding agreement between you and Sponsor and will govern your participation in any and all Program offers.
Being eligible for the Program entitles Best Friends Forever members (“Members”) to take advantage of certain Program rewards (“Program Rewards”) and offers that may change from time to time and which may be made available for limited times, all as determined by Sponsor in its sole discretion. You can fund out about available Program Rewards and offers by checking www.bestfriendsforeverpet.com. Sponsor reserves the right to modify these Terms and Conditions at any time, without notice to you, so it is important to check the Terms and Conditions periodically. Participation in the Program and/or redemption of Program Rewards is considered acceptance of these Terms and Conditions and any modified terms included therein. Sponsor may, in its sole and absolute discretion, cancel, change, suspend or modify any aspect of the Program and/or any Program Reward at any time, including the availability of any Program Reward, without notice.
ELIGIBILITY: To become a member of the Program, you must be a customer of a participating Best Friends facility (a “Participating Facility”) and over 18 years of age. To enroll in the Program, you may visit one of the Participating Facilities throughout the United States and provide your name and email address (optional). Customers of Participating Facilities will be enrolled automatically in the Program. Program Rewards can only be earned and redeemed at Participating Facilities, subject to availability and specific hours of operation. Employees of Sponsor and their immediate family members living in the same household of Sponsor are not eligible for Program Rewards.
By signing up for the Program, Members understand and agree that Sponsor may send you emails regarding this and any other Sponsor promotional offer.
TERMINATION: Sponsor may, in its sole and absolute discretion, cancel, change, suspend, or modify any aspect of the Program and/or any Program Reward, without notice. Sponsor may, in its sole and absolute discretion, terminate or suspend any Member’s participation in the Program for breach of these Terms and Conditions, or for taking any actions that are inconsistent with the intent of theses Terms and Conditions. Sponsor shall be the sole determiner in cases of suspected abuse, fraud, or breach of theses Terms and Conditions or intent of these Terms and Conditions. Any decision Sponsor makes relating to termination or suspension of any Member’s participation in the Program shall be final and binding in all respects.
GENERAL: Program Rewards are redeemable only at the Participating Facility in which they were earned. Program Rewards are not transferable to other Best Friends facilities or other Participating Facilities. The Program and/or the Program Rewards are void where prohibited by law. Sponsor is not responsible for any failures or circumstances affecting, disrupting or corrupting the Program or the Program Rewards in any manner including without limitation, Member’s ability to participle in the Program or any Program Rewards. Sponsor is not responsible for unavailable network connections; failed, incomplete, garbled or delayed computer transmissions; online failures; hardware, software or other technical malfunctions or disturbances; or any other communications failures or circumstances affecting, disrupting or corrupting the Program or the Program Rewards in any manner and Sponsor is also not responsible for any damage to any Member’s computer occasioned by participation in the Program or downloading of any information necessary to participle in the Program. By participating in the Program, Members release Sponsor, its parent, subsidiaries, affiliates, suppliers, advertising and promotions agencies and agents from any and all liability for any loss, harm, damages, cost or expense, including without limitation property damages, personal injury and/or death, arising out of participation in the Program and the use of or participation in any Program Rewards. Sponsor makes no warranty in any respect as to any merchandise or service available within the Program. Under no circumstance will merchandise or other services be refunded or exchanged for Program Rewards may be taxable, depending on the value of the item and the federal, state, and local tax laws applicable to you. Members are solely responsible for reporting such items on their tax returns and paying any associated tax liability. Members may not assign or transfer any Program Rewards.
Sponsor has no control over the Internet and cannot prevent the interception of messages by unauthorized parties or guarantee that such unauthorized parties may not be able to decrypt encrypted messages. Accordingly, under no circumstances will Sponsor be responsible for any loss or damage incurred by any Member as the result of unauthorized interception or decryption of information transmitted to or by Sponsor.
PROGRAM REWARDS: Members can start accumulating Program Rewards upon enrollment. All Program Rewards must be accumulated through Boarding and Grooming activities, described below. Boarding and Grooming Program Rewards shall be collectively referred to herein as “Program Rewards”. Boarding Nights and Grooming Services paid for with gift certificates are no eligible and do not count as “Qualifying” Pet Boarding Nights or Qualifying Grooming Services, as defined below.
Boarding Program Rewards: Members can ear one (1) free night of pet boarding at either a standard or luxury suite/condo after twenty (20) Qualifying Pet Boarding Nights. A Qualifying Pet Boarding Night is a paid, overnight stay at a Participating Facility in either a standard or luxury suite or condo. Day Care and Day Camp stays do not qualify. A boarding Program Reward is valid for only the standard or luxury suite/condo. All additional charges must be paid by Member. Boarding Program Rewards are accumulated per Member and may be used for any of Member’s pets. All Boarding Program Rewards are subject to availability.
Grooming Program Rewards: Members can earn one (1) half-price groom (i.e., 50% off) for Member’s pet after seven (7) Qualifying Grooming Services. A Qualifying Grooming Services is paid, primary shampoo or haircut service at as Participating Facility, costing $10 or more. All additional charges must be paid by Member. Grooming Program Rewards are accumulated per pet and may not be used for Member’s other pets. All Grooming Program Rewards are subject to availability. Program Rewards may not be combined with any other offers.
EARNING REWARDS: A Program Reward will be considered “earned” after Member accumulates either the twentieth Qualifying Pet Boarding Night or seventh Qualifying Grooming Service. Members may earn Program Rewards between October 1st and September 30th of each year (“BFF Year”). There is no limit to the number of Program Rewards a Member may earn in any BFF Year. If Member does not earn a Program Reward during a BFF Year. For example, if a Member accumulates nineteen Qualifying Pet Boarding Night Stays beginning on October 1st of that BFF Year, but fails to earn the twentieth Qualifying Pet Boarding Night Stay by the following September 30th, Member will forfeit all points accumulated during that BFF Year. Earned Program Rewards are not counted as “Qualifying” and may not be used toward earning additional Program Rewards.
REWARDS REDEMPTION: Members may redeem their earned Program Rewards at the check-out counter of the Participating Facility in which he/she was enrolled in Program and earned such Program Rewards. Earned Program Rewards expire three (3) years from the date on which they were earned. Cancellation terms for earned Program Rewards are dictated by the Participating Facility’s cancellation policy.
INDEMNIFICATION: You agree to indemnify, defend and hold Sponsor and its representatives and agents harmless from and against any and all third party claims, demands, liabilities, costs or expenses, including attorney’s fees and costs, arising from, or related to any breach by you of any of theses Terms and Conditions or any violation by you of applicable law.
GOVERNING LAW: The laws of the State of Connecticut shall govern these Program Terms and Conditions. You hereby expressly consent to exclusive jurisdiction and venue in the courts located in Connecticut for all matters arising in connection with these Terms and Conditions or your participation in the Program. |
